Terms & Conditions
Welcome to the MindStir Author Growth Club™, a service of Mindstir Media LLC. By enrolling in this membership program, you agree to the following Terms & Conditions, a binding contract between you and Mindstir Media LLC.
Membership
Membership is billed at $399 per month and requires an initial 12-month commitment. Payments are automatically charged each month using the payment method provided at enrollment. All membership fees are non-refundable.
Monthly Benefits
Members may redeem one (1) eligible marketing service per monthly billing cycle. Benefits must be selected and redeemed during the applicable billing period and do not roll over if unused. Benefits have no cash value, are non-transferable, and may not be exchanged for other services unless approved by MindStir Media. Benefits are listed here.
The following usage limits apply:
Premium Press Release – Maximum of two (2) per calendar year
X (Twitter) Blast – Maximum of two (2) per calendar year
Professional Blog Feature – Maximum of one (1) during the membership
All other eligible services may be selected once per monthly billing cycle, subject to availability.
Member Responsibilities
Members agree to provide all materials, approvals, images, book information, and other content necessary to complete selected services in a timely manner. Delays in providing required materials may delay service delivery but do not extend the monthly benefit period.
Renewal & Cancellation
After the initial 12-month term, membership automatically renews on a month-to-month basis unless either party provides at least 30 days' written notice of cancellation. Cancellation does not entitle the member to a refund for any fees already paid.
Changes to Services
MindStir Media reserves the right to modify, discontinue, or replace any membership benefit with a comparable service of equal or greater value at its sole discretion.
Termination
MindStir Media reserves the right to suspend or terminate any membership for non-payment, abuse of the program, fraudulent activity, or violation of these Terms & Conditions. If a monthly payment is rejected, MindStir will re-attempt to charge the payment method. If payment is still unsuccessful, the membership may be suspended until the monthly payment is made.
Limitation of Liability
MindStir Media makes no guarantee regarding book sales, bestseller status, media coverage, or any specific marketing results. Marketing outcomes vary based on numerous factors beyond our control. To the fullest extent permitted by law, MindStir Media's liability arising from or relating to the membership shall not exceed the total membership fees paid by the member during the preceding twelve (12) months.
Governing Law & Venue.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the MindStir Author Growth Club™ shall be brought exclusively in the state or federal courts located in Rockingham County, New Hampshire, and the parties consent to the jurisdiction and venue of such courts.
Payment Disputes and Chargebacks
By enrolling, the member authorizes MindStir Media LLC to automatically charge the payment method provided for all membership fees due during the initial 12-month commitment and any subsequent renewal period. Except in cases of genuine unauthorized use or a legally recognized billing error, the member agrees not to initiate or threaten a chargeback, payment reversal, or bank dispute for properly authorized membership charges and agrees to first provide MindStir Media with written notice describing the concern and a reasonable opportunity to investigate and resolve it. Filing a chargeback does not constitute cancellation of the membership or relieve the member of any payment obligation under these Terms. Any chargeback determined to be fraudulent, abusive, or inconsistent with these Terms shall constitute a material breach, and MindStir Media may immediately suspend or terminate services, submit these Terms and related service records to the payment processor, and pursue recovery of the disputed amount, chargeback fees, collection costs, and reasonable attorneys’ fees to the extent permitted by law. Nothing in this provision limits any non-waivable rights available to the member under applicable law.
